Assaulted ex-partner

Michael David Elder from Mourne Grange, Dromore was ordered to pay the woman £250 compensation and was bound over to keep the peace for two years in the sum of £500.

The court heard how he pushed the female causing her to fall back. The incident occurred after the couple had split up. Elder was babysitting and upon the female’s return from a night out, she was challenged about her whereabouts and the company she had.

District Judge Mr Copeland said this challenge precipitated Elder’s jealousy and rage.

He told Elder, “Under no circumstances can I accept that the incident was provoked by her. She was entirely innocent and you know that.”

A PPS Prosecutor explained how on April 7 at 7pm, police were tasked to Church View Drive after reports of a domestic assault.

The victim was in the living room and various items were scattered around the property. It was claimed that a row took place and Elder assaulted her.

The woman declined medical help and she later made a statement detailing the assault.

Elder was interviewed and made a partial admission. He admitted pushing the woman and this caused her to fall when he lost his temper.

Barrister Mr O’Hare said his client had a completely clear record and co-operated with police from the outset.

He said the agreed basis of his client’s plea was the fact he pushed the injured party.

Mr O’Hare claimed there was a degree of provocation on the night and a verbal argument broke out between the two parties.

Mr Copeland said, “This was a cowardly assault and you know exactly what you did and the extent of it.”.”
