When McBarron was discharged from hospital an evidential breath test gave a reading of 48.

The police had been called to the scene of the accident at 9.15am and the evidential procedure had taken place at 1.38pm.

A solicitor for the defendant said he had been staying at a friend’s house the night before for a party. McBarron was driving home when he took the roundabout too fast. He had no mobile phone and went to get help. He had friends in the car and one of them assaulted him leaving him unconscious.
