Attempted to bite police during arrest

A Dungannon man has been warned that any repeat of his drunken behaviour in public will result in his imprisonment.

The court heard how police received reports about a drunk man “staggering” on the Killyman Road on the afternoon of June 24th.

They did not find the man but discovered an abandoned car whose last registered owner lived in Redford Park.

The police were going in that direction when they came upon the defendant, 46-year-old Remigijus Simkus, staggering on the roadside of the Old Moy Road.

He immediately became aggressive and abusive in both Lithuanian and English, and attempted to walk into the road.

He was arrested but continued to struggle with police, attempting to bite one officer and headbutt another. He succeeded in kicking the police car door into a third constable.

His aggressive manner continued at Dungannon Police Station.

“Only a prison sentence is acceptable when someone engages in this level of violence against police officers,” said District Judge John Meehan as he imposed three month concurrent sentences for each assault on police. £400 compensation was also ordered for the constables.

“You are the only breadwinner and have responsibility for your family. That is the only reason that you are not going immediately to jail,” he said and ordered the sentence be suspended for two years.

“You would be very well advised to control your alcohol abuse. If you let yourself go again and show this type of behaviour you will serve those three months.”
